Terms of Service
These Terms of Service ("Terms") govern your use of the Trailair mobile application ("the app", "the service"). By installing or using Trailair, you agree to these Terms. If you do not agree, do not use the app.
1. The service
Trailair is a free cinephile companion that lets you discover films, build a personal watchlist, mark seen films, take cinema quizzes, and read a curated encyclopedia. Film metadata is provided by The Movie Database (TMDB); we do not host or stream any film content ourselves.
2. License granted to you
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Trailair on Apple devices you own or control, for personal, non-commercial use only.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code, except where expressly permitted by applicable law
- Use Trailair to violate any law or third-party right
- Interfere with the proper operation of the app or the third-party services it relies on
- Circumvent advertising or in-app limitations
- Resell, rent, or sublicense access to the app
4. Advertising
Trailair is offered free of charge and includes advertising delivered by Google AdMob. By using the app you acknowledge that ads will be displayed. See the Privacy Policy for details on how advertising works.
5. Third-party content
Film posters, descriptions, trailers and metadata are provided by The Movie Database (TMDB). Trailair is not endorsed or certified by TMDB. Where Trailair links to external services (streaming platforms, YouTube trailers), use of those services is governed by their own terms.
6. Intellectual property
Trailair, including its visual design, logo, original editorial content and source code, is the property of its publisher and protected by copyright. Film posters, titles, and synopsis remain the property of their respective rights holders, used here under TMDB's API terms.
7. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that film information is complete, accurate or up to date, nor that the service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, revenue or goodwill arising out of your use of Trailair. Our aggregate liability shall not exceed the amount you paid for the app, which for the free version equals zero.
Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g. consumer protection rights in your country of residence).
9. Termination
You may stop using Trailair at any time by uninstalling the app. We may suspend or terminate access if you violate these Terms or applicable law.
10. Changes to the Terms
We may update these Terms occasionally. The "Last updated" date reflects the most recent revision. Continued use of the app after a change constitutes acceptance of the new Terms.
11. Governing law
These Terms are governed by the laws of France. Disputes that cannot be resolved amicably shall be brought before the competent French courts, without prejudice to mandatory consumer protection rules in your country of residence.
